Voices of the Culture: Question Submission Terms & Conditions

By sending your recording of your question and/or speech ("Recording“) to the American Society of Composers, Authors and Publishers (“ASCAP”) in connection with the “Voice of the Culture" event to be held on or about June 22, 2021 (the "Event"), you grant ASCAP, and its employees, affiliates, representatives and agents (the “ASCAP Parties”) the unlimited, worldwide, perpetual and gratis right and license to use, edit, copy (including by taking screen captures), perform publicly, display, sublicense and/or otherwise exploit your Recording, your embodied image, likeness, voice and performance (including any musical compositions and/or sound recordings that are owned, controlled and/or licensable by you), all as contained therein, your name, social media name, location and/or handle and any biographical information provided to the ASCAP Parties, in each case via any and all technologies now known or hereafter created, through any and all ASCAP and third-party (including press and media outlets) platforms, including without limitation, websites, applications and digital media platforms, for the purpose of making available the Recording and Event to the public, reporting on, commercializing, promoting and marketing (including via the inclusion of third-party advertisements and sponsorships) ASCAP, its membership and sponsors and/or the Event, and for any archival and educational uses (“Permitted Uses”).
You warrant, represent and covenant that you have the right to create the Recording and perform at the Event and you have obtained all necessary consents and approvals from any and all third parties in order to do so (including without limitation record labels and music publishers). You agree to indemnify, and hold harmless the ASCAP Parties and their respective officers and directors from and against any claims, actions, demands, suits, losses, liabilities, damages costs or expenses (including attorney’s fees) arising out of or in connection with your Recording, your performance and the ASCAP Parties’ Permitted Uses. You release the ASCAP Parties and their respective officers and directors from any and all claims which you may now or hereafter have against any of them in connection with your Recording, your performance and the Permitted Uses. To the extent permitted by applicable law, none of the ASCAP Parties will not be responsible to you for: (a) losses that were not caused by any ASCAP Party’s breach of their respective obligations; or (b) any loss of profits, loss of revenues, loss of reputation, indirect or consequential losses, or punitive damages (in all cases whether such losses were foreseeable or not) or (c) any third-party claim for actual or alleged infringement of intellectual property rights.
