ASCAP first offered a license agreement for Internet music uses in 1995. Since that time, we have worked with many operators of Internet sites and services to develop the best licensing solutions for the ever-growing number of on-line music uses and business models.
We realize that as technology changes and users’ expectations of on-line music grow, ASCAP must continue to be a leader in Internet licensing. Accordingly, we are pleased to announce two new versions of our widely used Internet license agreements: "Non-Interactive 5.0" for non-interactive sites and services; and "Interactive 2.0" for interactive sites and services. A third new agreement, designed for "Wireless Music" (e.g., "ringtones" and "ringbacks"), is available on the Wireless Music page.

We designed the ASCAP Experimental License Agreement for Internet Sites & Services - Release 5.0 for sites and services that perform ASCAP music in a non-interactive manner. Currently, "non-interactive" means that users cannot select individual songs or collections of song unless the performance is not more than sixty (60) seconds in duration. |
We designed the ASCAP Experimental License Agreement for Interactive Sites & Services - Release 2.0 for sites and services that permit their users to select individual songs or collections of songs, such as an album. |
Examples of music uses that qualify for Non-Interactive 5.0 include:
- Webcasts
- Performances that are embedded in a site or service, such as a "Flash" intro
- "Samples" (i.e., song excerpts that are not more than 60 seconds in duration)

Examples of music uses that qualify for Interactive 2.0 include: - "On-Demand" performances (e.g., Internet "jukeboxes" and music videos)
- "Custom radio" (user-determined playlist)
- "Pay-per-Play" or downloads of individual songs or albums
